Appeals Court Hearing Set on Open Space Decision

The First District Court of Appeal in San Francisco has set December 11 for the hearing on CARRQ's appeal of the County and Open Space District's decision to allow Roblar Road quarry owner, John Barella, to use his neighbor's property that is protected by a tax-paid conservation easement as replacement land for tiger salamander habitat that will be destroyed by the quarry operation.  In 2011 CARRQ and two neighboring ranch families sued the County over their "interpretation" of this conservation easement that directly benefitted the developer which is a gross misuse of the publicly-funded easement.  Sonoma County Superior Court Judge Elliott Daum denied CARRQ's motion August 16, 2011 and we have awaited this date at the Court of Appeals.  Mr. Barella and the County have requested oral arguments to be heard and the Court has agreed to hear very brief arguments from both sides in this case.  To read more:
